Dairy Farm Agrees to Settle in Pollution Case
Wisconsin Ag Connection - 11/28/2005
An
agreement has been reached between a Kewaunee County dairy operation
and a Luxemburg family over manure pollutants that allegedly washed off
of afarm field and into the family's water supply.
According to court reports, Glen Stahl of Stahl Farms is being sued by Scott and Judy Treml, who claim that the farm
had spread about 84,000 gallons of liquid manure on an 80-acre field
last year. But after the snow melted, much of that manure seeped into
the water supply of the Treml home.
Officials say $200,000 will be used for the installation of new environmental improvements at Stahl farms,
including enlarged manure storage structures and runoff control devices
to prevent the need to spread liquid manure in frozen snow-covered
ground in the future. Stahl is also liable to the state for $100,000 in
civil penalties for violating his DNR issue to discharge permit on
several occasions. However, that can be reduced to $50,000 if Stahl
implements all of the environmental improvements that he is obligated
to install.
Another
$80,000 will go directly to the Treml family for compensation of
replacing their well and for medical expenses as well as pain and
suffering.
